On January 10, at approximately 12:45 PM, I went to the Family Dollar Store on Isleta and Rio Bravo (1625 Rio Bravo Blvd SW, Ste. 22, Albuquerque, New Mexico 87105-6059) to make a product return. As I was attempting to enter the store, a store employee, a woman, was standing in front of the door, smoking, in violation of the New Mexico Dee Johnson Clean Indoor Air Act (NM Stat § 24-16-13 (2021).) I was forced to walk around the employee (through the cloud of smoke, which irritated my diagnosed breathing problems,) and up to the front counter, where I started to make my return and bring my complaint about the smoking employee to the cashier's attention, as it is the responsibility of EVERY EMPLOYER in New Mexico to enforce the New Mexico Dee Johnson Clean Indoor Air Act (NM Stat § 24-16-14 (2021).) The employee, a gentleman, was helping me with my return, a defective ring light that was missing parts when I bought it, when the employee who was smoking at the door came in and retaliated against my complaint by refusing to allow me to return the ring light. Retaliating against anyone for requesting enforcement of the New Mexico Dee Johnson Clean Indoor Air Act is a clear violation of the New Mexico Dee Johnson Clean Indoor Air Act NM Stat § 24-16-19 A. (2021.) When I told the employee, who would not give me her name and continued to treat me rudely and condescendingly, that she was in violation of the law and that retaliation was also illegal, she became more hostile, continuing to refuse to assist me. I informed the employee that I would bring my complaint to corporate to which she laughed and said "go ahead." I then attempted to leave to deescalate the situation, she followed me out berating me, yelling that the law was a "city ordinance, and we're in county." I felt frightened by her retaliatory, aggressive, and abusive behavior, especially since it was all simply because I had brought up the FACT that she was violating state law. As far as the actual penalties for violating the act, and the individuality of each act, the acts were separate and distinct acts, first, the smoking outside, second, the employer not enforcing the New Mexico Dee Johnson Clean Indoor Air Act, and finally, the retaliation for requesting enforcement of the act, and the subsequent threatening and verbal accosting after following me out. (2 clear violations of the ban on retaliations,) the New Mexico Dee Johnson Clean Indoor Air Act has a progressive penalty: The first violation of the New Mexico Dee Johnson Clean Indoor Air Act, in this case the smoking at the door, is punishable by a $100 dollar fine, in accordance with the New Mexico Dee Johnson Clean Indoor Air Act NM Stat § 24-16-18 A. (2021). A second violation within 12 consecutive months, the employer not enforcing it in this case, is punishable by a fine not to exceed $200.00 NM Stat § 24-16-18 B. (2021). A third or subsequent violation in 12 consecutive months, is punishable by a fine not to exceed $500.00 NM Stat § 24-16-18 C. (2021) The statute does not waive additional civil penalties, city, or county ordinance violations, or civil complaints for discrimination or retaliation.

This store is ALWAYS closed. Every time I go there there's some sign on the door and the employees are just standing around inside. Someone needs to report them to corporate at this point I'm fairly certain they do it just to be lazy.

This place is always closed during business hours. They slap a sign on the door and lock the doors. It's been that way on 4 separate occasions now. No way they're "system" is down that often.

We were at the Family Dollar on Rio, bravo just the other day and the girls were eating food right there in front of you and very rude. We asked him a question, they just said what real rude, no wonder where to go to the store

Place is a joke. Today I took my son just about 15min before they were closing. Mind you, just to grab dish soap and paper towels the door was locked. At least 4 customers were inside. The door was locked, 15min before closing. What was the reason to close early? Because it’s Valentine’s Day tomorrow? Sign read , No Valentine school cards. Associate came to the door to let customers out and said they were closed. I asked for a manger, his Name was Alex. I asked if they close early. He said no at 9pm but yet it was 850pm. I get it people are tired and want to go home. But if you’re going to close early have a reason. I saw Alex at 8:53 put a sign saying “-Closed, Thank you CLOSED!!!” If you’re not going to stay open till 9pm change your time.

The manager was irate, rude and dismissive. I asked a question about refunds and he proceeded to scold me in a loud voice in front of the whole store, which was uncalled for. It made me angry. I've never been treated like that in this area. Albertsons, Walgreens etc. My whole life. I'll just drive the extra miles to the next location. I.

Gah its just awful, the staff obviously hates customers...this poor lady was looking for something they advertised and she asked one of the workers for help and they were so rude to her I couldn't believe it. I think this place is hell to work for, so I guess I can't blame the staff for acting like they hate everything but it's really getting worse every time I go in there.
