I am filling the forms to spark an investigation. If your EBT card balance was stolen and spent here make a police report, contact city licensing and file a complaint with the USDA stating the following making sure to change the state to where you are located. They played with the wrong one:
I am writing to formally lodge a complaint regarding suspected EBT fraud, activities and code violations by Thirty Eight Corporation, located at 6000 Chester Ave, Philadelphia, PA 19142. I believe this establishment is accepting SNAP benefits without meeting the necessary eligibility requirements set by the USDA.
I live in Alabama. My card along with the card of many others has been used at this location without our authorization or knowledge.
Based on my observations, I believe this business is violating several USDA regulations regarding the SNAP program and fails to meet local business licensing and building code requirements in Philadelphia.
SNAP Program Violations:
Thirty Eight Corporation appears to be violating critical USDA SNAP guidelines, including:
1. **Out-of-State Card Use Without Physical Presence**: Under USDA regulations, SNAP transactions require that the EBT card be physically present and swiped at the point of sale by an authorized user. The acceptance of out-of-state EBT benefits without the physical card being present or swiped constitutes a significant breach of USDA guidelines and increases the risk of fraudulent activity (7 CFR § 278.2). Transactions conducted without proper verification and physical presence of the cardholder indicate potential misuse and fraud.
2. **Eligibility and Stocking Requirements**: USDA-approved SNAP retailers must meet minimum stocking requirements, carrying a minimum of three units of three staple food varieties in four food categories: fruits/vegetables, dairy, meat/poultry/fish, and bread/cereals (7 CFR § 278.1). Additionally, two categories must include perishable items. This requirement is designed to ensure that SNAP recipients have access to a diverse range of nutritious food options, which supports the program’s objectives.
3. This location also appears to be accepting SNAP benefits for hot food.
Business Licensing and Building Code Violations:
Aside from suspected SNAP fraud, Thirty Eight Corporation appears to be in violation of several local business and building requirements in Philadelphia, including:
1. **Business Licensing**: Philadelphia’s Department of Licenses and Inspections (L&I) mandates that all businesses operating within the city maintain an active Commercial Activity License, as well as a Food Establishment License if they sell food items. These licenses are essential to ensure that businesses comply with local health and safety regulations. Operating without these licenses is a violation of Philadelphia’s business code and may carry penalties (Philadelphia Code § 19-2600).
2. **Building Code Compliance**: In addition to proper licensing, commercial establishments must adhere to Philadelphia’s building codes. Buildings open to the public must be maintained to meet health and safety standards, including fire safety, sanitation, and structural soundness. Based on my observations, the building housing Thirty Eight Corporation appears to be in disrepair and potentially hazardous, which could constitute violations of the Philadelphia Building Code, including basic standards for maintenance, accessibility, and public safety (Philadelphia Building Code Title 4).
These compliance failures raise significant concerns for community health, safety, and welfare. I respectfully urge an investigation into these matters to ensure the SNAP program’s integrity and that local business and safety standards are upheld.
